Stamp Duty Land Tax is complex and ever-shifting, subject to more alterations since it was introduced in 2003 than any other comparable tax. The legislation governing it is now full of exceptions, exemptions and reliefs, aimed at covering the vast variety of property types and property buyers.

Not all of these are obvious to conveyancers and property solicitors who are generally inclined – thanks to lack of help from HMRC and conflicting messages from their regulator, the SRA – to differentiate simply between a whether a property is residential or commercial for purposes of SDLT calculation.

Stamp Duty Land Tax (SDLT) becomes due when you buy property or land in England and Northern Ireland. This is known as Land and Building Transaction Tax (LBTT) in Scotland and Land Transaction Tax (LTT) in Wales. The amount of Stamp Duty Land Tax (SDLT) you pay will be different and will depend on many factors such as type of property, type of buyer, value of property, buyer status, etc. The legislation on Stamp Duty Land Tax (SDLT) includes various reliefs and exemptions to cover the various types of properties and buyers. Due to the various factors involved, Stamp Duty Land Tax (SDLT) tends to be very complicated. Many buyers end up overpaying Stamp Duty Land Tax (SDLT) and would be eligible for a refund.
You could be entitled for a Stamp Duty refund in the following scenarios:
  • You have paid additional Stamp Duty Land Tax (SDLT)on your second home and sold your main residence within 3 years of paying the additional 3% Stamp Duty Land Tax (SDLT)
  • You have paid additional 3% Stamp Duty Land Tax (SDLT) on a property which is uninhabitable
  • You have paid additional 3% Stamp Duty Land Tax (SDLT) with an annexe or granny flat on the grounds of your main home
